The following terminology applies to these Terms and Conditions, Policies, and any Agreements: “client”, “customer”, “you”, “your”, and “Consignor” refers to you, the person accessing this website, purchasing, consigning, and/or using our services and accepting the Company’s Terms and Conditions. “Company”, “ourselves”, “we”, “our”, “us”, and “Consignee” refers to our Company, Brilliant Jewellery & Repair, and any affiliates thereof. “Parties” refers to both aforesaid groups.
We reserve the right to change Our Terms and Conditions, Policies, and Agreements at any time.
Unless otherwise specified, all items remain within our care and sufficient insurance coverage will be maintained to cover damage or loss. In the case of damage or loss while in our care, we will repair or replace with a similar item of comparable value (unless otherwise noted). We are not responsible or liable for any pre-existing damage or wear of an item when it enters our care. Items entering our care or being offered for sale are identified (materials and components such as stones) by our in-house jewellery professionals to the best of our knowledge, and/or the knowledge of our appraisal partner(s). If we recommend a repair or service be done and you opt to decline, we are not responsible for damage or loss incurred relating to the recommendation.
After items are purchased and picked up, we are not responsible for accidental damage, stone damage, loss due to fire, theft, or otherwise, exposure to moisture, chemicals or any excessive or abnormal wear. We recommend discussing insurance coverage options with your personal insurance provider. Our warranties and specific responsibilities are outlined in the policies below.
We reserve the right to modify our prices and/or services offered.
We accept layaway for items in our showcase over $200, pre-tax. A non-refundable deposit of 25% of the total price (including tax) is required to initiate a layaway agreement. By paying the deposit, you are agreeing to the terms and conditions outlined in this policy.
Regular monthly payments are required to continue the layaway agreement. Layaway agreements will not extend beyond a period of 4 months (unless an alternate agreement has been made). If no payments are made for a period of 3 months, we reserve the right to terminate the layaway agreement.
In the case of termination of the layaway agreement either by us, or the customer, the 25% non-refundable deposit will be forfeited. Any other payments received prior to termination of the agreement (excluding the deposit) will be converted to store credit. Any claim to the item by the customer will be forfeited.
Layaway payments can be made in person (Cash, Debit, Credit Card), by phone (Credit Card), e-transfer, or PayPal.
If for any reason you would like to return an item purchased from our showcase, it can be returned within 7 days, for a full refund, credited in the original method of payment, OR exchanged for store credit.
Proof of purchase is required, and item(s) must be in original condition (no indications of wear, alterations, engraving, etc.), and include any original packaging and paperwork (appraisals or certificates) that were included at the time of purchase.
Returns can be initiated in person at Brilliant Jewellery & Repair, or Brilliant Jewellery.
Discounted items, Repair Jobs, Custom Build Agreement pieces, items purchased during “Live Online Sales”, Gift Cards, and items that have been personalized or altered are final sale.
Items purchased from our showcase for a purchase price over $2000 include an initial complimentary sizing. A 50% discount on our sizing fee is offered for purchases made from our showcase under $2000.
Some exclusions may apply such as gold that is 19 karat or higher, eternity settings, patterned bands or unique designs may not be eligible for sizing or be subject to an additional sizing fee.
Complimentary sizing must be completed within 30 days of the purchase date.
If we recommend a size (ex. for a ring) and it does not feel right, we will offer one additional sizing at no charge, within 30 days.
We offer a fair market value for gold, silver, and platinum material (jewellery, broken or damaged jewellery, coins, etc.), as well as for semi-precious, precious and diamond stones.
By offering the items, you acknowledge that you own right and title to the items being offered for material purchase and have the authority to sell them.
Materials will be identified, weighed, and an offer made to the customer. The offer is valid only at the time it is made.
When an offer is accepted by the customer, a cheque or store credit note will be issued for the offer amount. Government issued photo identification is required and payment will be issued using the name on the identification. At the time payment is issued to the customer, we own the right and title of the items in the transaction.
All material purchase transactions are final sale.
“Live Online Sale” refers to any sale of items through an online, live-streaming service (such as but not limited to Instagram or Facebook).
We use reputable shipping companies including, but not limited to, Canada Post and FedEx. As required, accurate customs declaration forms will be included with all international shipments. Any customs or brokerage fees are the responsibility of the customer. A tracking number will be provided when your package(s) has been shipped.
Shipping is a flat rate within Canada and the United States and does not include shipping insurance coverage. Shipping insurance is available for an additional fee. A quote will be provided for shipments outside of Canada and the United States. Shipping insurance within Canada is optional, but strongly recommended. Shipping insurance is required for shipments to the United States or other international destinations.
When packages are shipped with the requirement of a signature upon delivery, collection of the signature is at the discretion of the shipping company. It is the customers responsibility to ensure a correct shipping address is provided.
If you purchased shipping insurance and experience a lost package or damaged item(s), we will initiate a claim on your behalf. You must contact us within 14 days of the shipping date to ensure a claim can be submitted within the eligibility period.
If you are shipping an item(s) to us, you are responsible and liable for the package and its contents until we accept the delivery. The customer is responsible for all associated shipping and insurance costs. Once the item(s) is delivered to us and within our care, we are responsible as outlined in our Limits of Liability. The customer is responsible for any applicable return shipping and shipping insurance costs.
We offer consignment for select pieces at our retail locations. We reserve the right to approve or deny items for consignment. To consign an item(s) with us, a Consignment Agreement will be initiated.
By consigning a piece, you acknowledge that you, the Consignor, own right, and title to the items you wish to consign and have authority to sell them. By entering into a Consignment Agreement, you authorize Brilliant Jewellery & Repair to take possession of the consigned item(s) with the intention and exclusive right to display and sell them to a third party. During the Consignment Agreement, we will not alter the consigned item(s).
A Minimum Price for each item will be determined within the Consignment Agreement. This will be the amount paid out to the Consignor upon sale. Eligible amounts will be paid to the Consignor within 30 days of sale. At the request of the Consignor, the Minimum Price can be reduced at any time by modifying, in writing, the Consignment Agreement.
We are entitled to the Consignment Fee, which is the difference between the full purchase price of the consigned item(s), less the Minimum Price.
The Consignment Agreement is valid for a period of 3 months from the date it is initiated. Upon agreement by the Consignor and Consignee, the Consignment Agreement can be renewed for an additional 3-month period.
The Consignment Agreement can be withdrawn by the Consignor by providing 48 hours notice verbally or in writing to us, requesting the return of the specific consigned Items.
The Consignment Agreement can be terminated at the discretion of either party by providing 48 hours notice verbally, or in writing.
We acknowledge and agree that the consigned Items will only be stored at the location(s) specified in the Consignment Agreement and that sufficient insurance coverage will be maintained to compensate the Consignor (fair market value or Minimum Price) in the event of damage or loss due to fire, theft, or otherwise.
Consignment Agreements are required to be initiated, modified, and terminated by signing, in person, and agreed upon by both parties.
We offer a limited warranty on items purchased from our showcase, explicitly outlined below. Any applicable warranty period begins at the time the customer receives the purchased item.
We reserve the right to void any warranty if the item is altered by anyone other than an authorized Brilliant Jewellery & Repair representative. Warranty does not cover accidental damage, stone damage, loss due to fire, theft, or otherwise, exposure to moisture, chemicals, or any wear deemed excessive or abnormal by our in-house jewellery professionals. This warranty does not cover any damage or loss where a recommendation was made by our in-house jewellery professionals, but the customer opts to decline the recommendation and proceed at their own risk. We recommend discussing insurance coverage options with your personal insurance provider.
We take pride in selling heirloom quality pieces. All items are carefully inspected by our goldsmiths prior to being offered for sale.
Estate items are sold AS IS.
Items identified in our showcases as Brilliant Jewellery & Repair custom builds are eligible for the Custom Build Warranty, specified below.
Pieces built by Brilliant Jewellery & Repair identified as a custom build in our showcase include a 6-month limited warranty covering defects in material or workmanship. Any applicable warranty period begins at the time the customer receives the purchased item(s).
Under warranty, we will repair defects, free of charge, upon inspection by our in-house jewellery professionals, otherwise, a quote for repairs will be provided.
Warranty does not cover accidental damage, stone damage, loss due to fire, theft, or otherwise, exposure to moisture, chemicals, or any wear deemed excessive or abnormal by our in-house jewellery professionals. Repairs, alterations, or services performed on your piece by anyone other than an authorized Brilliant Jewellery & Repair representative will render this warranty null and void.
Jewellery requires upkeep and maintenance, especially with frequent wear. We recommend having pieces inspected regularly to ensure the integrity of the piece (claws, wear, etc.). We offer complimentary visual inspection and cleaning at any of our locations.
